Ky Ngo no-show in court today

Ky Ngo (photo) wasn’t there when his name was called in Orange County Superior Court today.

The main player in the protests against Little Saigon-area newspaper Nguoi Viet daily, Ky Ngo has been sought by the police. In open court yesterday on Nguoi Viet’s motion for a preliminary injunction, his lawyer Geoff Lyon told the judge that five police cars had been out on Monday looking for Ky Ngo. Two Westminster PD officers were also in the audience. “We’re just curious,” they told the Bolsavik. Really? That’s all? Not looking for anyone in particular?

This morning was the arraignment for Ky Ngo over at West Court on a misdemeanor charge. He’s accused of illegally operating a power generator. The generator had been used for a heater and lights when he’s out protesting at night in front of Nguoi Viet’s offices.

Guess what? He wasn’t there. His name was called, and no one answered. No Ky Ngo, no attorney, nobody.

The prosecutor on duty, Deputy City Attorney Elena Gerli, told the Bolsavik that Ky Ngo is charged with violation of Westminster Municipal Code Section 8.20.030(T), which reads (for those of you into this sort of thing):

(T) Violate Land Use Ordinance. To construct, erect, alter, move or maintain any building or structure contrary to the provisions of the Land Use Ordinance, or to use any property contrary to such ordinance, or fail to comply with any condition attached to the granting of a conditional use permit, variance, or site plan; or to conduct or operate a commercial activity in any zone without a business license.

Basically a zoning violation, which is Gerli’s specialty. “I do code enforcement,” she said.

Now that Ky Ngo didn’t show up, what happened? An arrest warrant for failure to appear? Maybe, Gerli shrugged.
