
Taking a more aggressive stance than when she was running for OC Supervisor, at yesterday’s Westminster City Council meeting Dina Nguyen spoke out against the proposed bridge (artist’s rendering, above) across Bolsa Avenue, even though the Council already pulled the item from the agenda.
The council was supposed to discuss and vote up-or-down on a proposal by the County to pay for and build a pedestrian bridge across Bolsa Avenue. The bridge would be, in all fairness, exactly where the most pedestrians would cross, right in front of Asian Village Mall (“Phuoc Loc Tho” to Vietnamese).
However, the bridge being there would link two shopping malls, one owned by and the other managed by Bridgecreek, the same company that once banned Andy Quach‘s political signs on its properties.
The bridge, dubbed “Freedom Bridge,” is a cornerstone of OC Supervisor Janet Nguyen‘s agenda and electoral platform. As a result, in addition to all the reasons people may have to support or oppose the bridge, their feelings for Janet, one way or the other, play a role as well.
Back to the Westminster City Council. As soon as the meeting began, Mayor Margie Rice, who was the one putting it on the agenda, proposed to pull it. Apparently, the members had a problem with one sentence in the county’s proposal. The proposal stated that County CEO Thomas Mauk had “negotiated” with City Manager Ray Silber, but apparently there couldn’t have been any negotiations. It seems such negotiations would have violated some laws or another. And since nobody should be violating anything — well, you know how it goes.
So the motion to pull the agenda item passed 4-0, with Frank Fry (who’s up for reelection) abstaining.
But the motion was made after people have signed up to speak, so they still spoke.
Some were for, some were against the bridge. And then Dina came to the podium.
Dina, of course, is a councilwoman in the neighboring city of Garden Grove. She spoke forcefully against the bridge, which begs the question: Why bother, when the item’s been pulled?
Anyway, so Dina’s points were, in random order: That the bridge doesn’t solve Bolsa traffic problems; that the bridge will attract drug users and the homeless; and that it really should be on Beach Boulevard near her office.
drug dealers and homeless? does that mean her brother might be tempted to hang out on the bridge and sell drugs to the homeless?
No, my concern is when Janet’s mad/drunk disoriented white boy friend jumps off from the Bolsa’s “free flying bridge” one night…. and barely surviving…but killing the passenger of the on coming vehicle,
Which city or county should carry the liability insurance?
I think it was wise for Dina to speak against “BIG LIABILITY BRIDGE”.
Initial $3 million plus $100 million lawsuit means straight to the bankrupcy for average sized city.

Your hypothetical would leave the individual’s estate liable, not the City/County (notwithstanding the fact that lawyers can name whoever they want as defendants.) The better example here is if the bridge collapses, killing unemployed protesters, who’s on the hook? The City/County likely if tender the defense to the bridge builders pursuant to an indemnification agreement. If there is no such agreement (which is unlikely), the City has a self-insured retention, and excess carriers, and possibly coverage beyond that. That’s assuming your plaintiff’s counsel can get pass the several tort immunities government entities enjoy.

And if we’re adopting Jung Kim’s argument that government’s shouldn’t build because doing so subjects an entity to liability, should governmental entities not build schools, hospitals, roads, etc.? Lastly, And isn’t there currently bridges all over OC/Westminster which subjects the entities to liability?

Your two or three cents is all it’s worth…… we often see drivers filing law suit against cities for failing to maintain safe(?) street rail guards! Someone gets hurt from this bridge I am positive city or county will have to be get involved.
The $3 million Janet’s bridge that only benefits a shopping center owner and her political campaign contribution book …….but the liability to maintain it is passed on to the city (with additional tax payer’s burden) is absolutely WRONG!

Im not sure if the Freedom bridge is going to solve traffic problem. This bridge will attract protesters. They will stand on the bridge with their flag and banner in hand and camp out there 24/7. These are the homeless Dina refering. Base on the render this bridge, how the handicaf get on the bridge? Where is the access ramp or wheel chair ramp? Talking about maintenance, Dina Quach and other Trannies had supported the Dragon welcome truss gate at Bolsa & Magnolia. This steel truss beam will cost a lot to maintain. Who is going to pay for this? These idiots just want to sabota whatever that has Janet stamp on it. I think the bridge should be paid for by the shop owners in the area. They are the one who create the traffic problem. Im not sure how much tax $$$ they had generated for the city.

Obviously you can’t read or don’t understand facts very well. The Trannies did not sabotage this stupid bridge, if you can even call it a bridge. Either you are Janet herself or Andrew Do blogging on this blog, you do sound desperate and go way out of your way to to blame everything on the Trannies, which is very wishful in your thinking.
Get one thing straight — Janet Nguyen and her sycophants Andrew Do and Nick le Cong made the most fundamental but elementary mistake on this issue. They accepted state bond money and tried to unilaterally ram a bridge down the City of Westminster, which is independent of the County and was not even consulted on the feasibility of this so-called project. Community input was zero as well. Good government at its worse.
Janet Nguyen and Andrew Do just gottheir heands burned on this whole matter. But it’s a good, hard lesson for them that you have to work and cooperate with people to get things done, instead of hiding and evading so that you can claim credit and score political points. So far, Janet and Andrew are eating goose eggs on this project! People out there are not fooled by this bridge charade.

Seriously folks, your comments from Jose S. at the start with the exception of one or two intelligent remarks are really displaying your ignorance of government processes.
First let’s start with the fact that this bridge was talked about between the City and the County. Full “negotiations” apparently didn’t take place but there was communication on the subject between the Mayor and the 1st District Supervisor. The subject of the bridge was brought up at previous council meetings as well, no matter how much some council persons wish to deny it.
Second, if you got a copy of the agenda item 5.3 of the City Council Meeting of 8/27/08 and read the cover letter from County Executive Officer Thomas Mauk, and the accompanying Agreement No. D08-043 you might be able to understand the contents which delineate the responsibilities of the parties.
The land/street where the bridge would be built would be ceded over to the county only while it’s being built. That means the county covers all liability instances and holds the city harmless from same. (No I am not a lawyer).
When the bridge is completed, inspected and signed off as completely safe by the engineers, the land and street is then ceded back to the City. Yes, then the city is responsible for maintenance of the bridge.
Remember that there was a group that wanted to build “archways” in the same spot, but they would have only served a decorative purpose and again, the city would have been responsible for the street and any liability during the building of that; and the maintenance thereafter.
I have not seen a rendering of the bridge, except for on the Bolsavik’s web site here in this article. But I know there are pedestrian walkways that are constructed that have handicap ramps that do not involve heavy maintenance such as an elevator would.
So it appears the trannies’ have come here to comment badly about the 1st district supervisor. I think the comments from Dina Nguyen exhibit her basic personality, which by the way, no one should call “sweet”. To come to another city to attempt a public “catfight” with her former rival in an election is really, well, sad. The First District Supervisor of course would not engage in such low level activity; and left as she shook hands with supporters on her way out after the agenda item was pulled.
Remember the days when most of the state money went to Santa Ana and other surrounding cities? Westminster has a chance to get some of that money now, and I am amused at the infighting of the various “groups” that never seem to know when they should join forces on something and put aside their personal anger on things that can not be changed.
