Cousin-killer got 10 years

The Viet from New Jersey who was nabbed at Newark airport for the killing of his cousin (read Bolsavik here) got 10 years for the stabbing, reports the New Brunswick Home News Tribune here.

Kha Duc Nguyen, 31, was accused of stabbing Tuan Nguyen, his 24-year-old cousin by marriage, on July 27, 2004.

Tuan Nguyen’s body was discovered slumped against the door of his family’s apartment by his father, Joseph Nguyen. According to autopsy results, Tuan Nguyen died of multiple stab wounds to the back, neck and chest.

A press release previously posted by the prosecutor’s office here claims that Kha fled out of Jersey three days after the killing, and stayed in Vietnam for 4 months.

Kha was tracked down when he flew back from Vietnam to Newark, and was arrested at the airport.

During police questioning, Kha admitted that he entered the victim’s apartment with his brother, Khuynh, and stabbed Tuan Nguyen to death during the course of a robbery.

These statements, however, were held inadmissible because they were obtained after Kha already invoked his Miranda rights. The judge’s exclusion order was upheld on appeal.

Kha has been incarcerated in lieu of $750,000 bail since his arrest in November 2004.

With time served, Kha will be out in six years.

Now, how is a man who killed with robbery intent getting 10 years, whereas Jonathan Phong Khanh Tran, who started the evening going out only to get sex-for-pay, here, is getting 62 years to life?
