The people seeking to recall San Jose City Councilwoman Madison Nguyen, needing to get 3,162 petition signatures by September 12, last Friday turned in two-thirds more than that number, submitting 5,181 signatures two weeks early.

According to the Little Saigon Inside blog, the recall team said they actually gathered 7,000 signatures, but didn’t want to have to verify them all so submitted only the 5,181.
Supporters of the recall efforts (not themselves on the committee) gave the Bolsavik various explanations as to why the committee submitted the signatures two weeks early. One said they wanted to show up the people who were badmouthing that they didn’t even have 1000 signatures. Other thought they were tired and just wanted to get it done and over with and move on.
Well, whatever the reason, it struck the Bolsavik that the recall camp may not have thought it through and may have handed Madison Nguyen an advantage.
Part of Madison’s strategy has always included getting people who’d signed to retract their signatures. Her web site has “Withdraw Name from Petition” in big bold letters right below the two flags.
With the signatures submitted, the recall side has handed over on a silver platter the specific names and addresses for anti-recall supporters to target.
If 3,162 signatures remain on the petition, the city will have to hold a recall election. It’s too late now for this November, so a special election will have to be set up. The cost of just such an election — $350,000 — has been part of Madison ngueyn’s argument against recalling her.

I’ve read a lot of your blog entries, especially those around Councilmember Madison Nguyen.
One thing mentioned that is not correct is the number of signatures needed for a recall election. Under your link to the Merc article, it states that “At least 90 percent must be valid or the petition will be rejected entirely. ” It will not matter how many signatures are valid but what percentage pass a computer verification test as being the same signature from the person’s voter registration card. I’m not sure exactly how many signatures will be checked but in a rumor I heard it was 500.
Also, from my understanding of the matter, I do not think that the city clerk can accept any withdraw signatures to have their name removed from the recall ballot after the recall signatures have been submit. Councilmember Nguyen’s “No recall” team will most likely not have the names of those who signed a recall ballot because the city clerk is the one handling the signatures. Most likely this section will be removed from Council Member Nguyen’s website after the “no recall” team comes up with a plan of action.
I’m not positive about this second point, but it is most likely written somewhere in the recall election procedures.
