Madison won, beat back recall - but y’all knew that already

Turns out people don’t need the Bolsavik after all. While the Bolsavik was at orchestra practice, polls closed in San Jose and Councilwoman Madison Nguyen handily won 55-45, according to numbers with all precincts reported here. This blog’s readers were already leaving comments here about the election result, even before the Bolsavik ever made it past his front door.
In another sign that the traditional polling booth may be becoming obsolete day by day, this special election was decided most by mail ballots, with 9,502 people voting by mail and only 2,247 showing up at the precincts.
That’s more than 4-to-1 voting by mail.

People hate both Madison and recall backers. She wins just because voters were getting sick of those red-baiters and their bullying tactics. There is no winner today, only losers, and the biggest loser is the Vietnamese community in San Jose. Madison wins, her political position is strengthened. But I have a feeling that it is not over yet.

The biggest loser in all of this is not the radical, loud mouth, good for nothing LT group. It is the SJ Vietnamese Community as a whole that just lost very big with this whole recall effort and the protesting of “Saigon Business District”. The fall out of this is that Madison will probably lose her seat in the city council two years from now. The residents of SJ that are not Vietnamese will think twice about electing another Vietnamese to any public offices any time soon. We will lose the only voice in the city council that has the Vietnamese community interests in mind.
The Vietnamese community in San Jose just took a step backward because of this recall. The people who are responsible for this recall effort and the protesting in front of the city hall should be ashamed of themselves. They just did a huge disservice to the Vietnamese community and make us the laughing idiot to other ethnic groups.
It is inconceivable to me that a Vietnamese group spearheads a recall and to destroyed a career of a Vietnamese politician in a city where Vietnamese political power is so much needed. Our ancestors are turning in their graves right now.

While this is a victory to Madison Nguyen, it is not a loss for those who wanted to recall her. And it is not a loss for the Vietnamese community. I am sorry but I can not see how it is not a lost for the SJ Viet Community. It is a lost for the SJ Viet Community because Madison political aspirations are damaged because of this. It is harder for her to suggest or come up with any new ideas to help the Viet Community without others sitting in the council think that it will create another controversy. She has become a political liability going forward.
More importantly the stigma of SJ Viet community as a group that is ready to protest for any minor things will stick to the mind of many residents in San Jose. They will think twice about voting for another Vietnamese to hold public office going forward.
As for Viet Community has political weight, I beg to differ on that. We might have made a lot of noises with this recall, but it is all within the Viet Community. Outside of the Viet Community, we are as ethnic group is still very weak in term of our political power. Do you think that if a Latino person or African American are elected to that seat, do you think that they will care of what those who wanted to recall Madison have to say or any Vietnamese for that matter. The naming of that little section of Story Road wouldn’t even be an issue because it wouldn’t have come up in the first place.

Strictly speaking, morality and fairness may overlap but are two distinct things. Life is inherently unfair, but not necessarily immoral.
What we are talking about here is what prescribes in a democratic system. You elect someone and if you are unhappy with him/her then you can attempt recall him/her. The recall election of Madison Nguyen followed what the system says. Yes, some individuals bad-mouthed her, but overall everything followed the rule. There are no immoral acts in this political process.

Don’t take it personally, but here in the O.C., it’s the local news we are interested in.
San Jose political potpourri is just peripheral knowledge pulling about the same attention as the prospect of a giant toxic entity destroying our country (an asteroid, not Rush Limbaugh).
By now it was obvious, she pulled it out.
Poor Madison, it probably take years before she could wipe the smile off her face.
Why did it happen?
There is an old saying “If you know neither the enemy nor yourself, you will succumb in every battle.”
It began when she was simply listening (???) to that deep-seated female instinct to say no to something. Then there was the rumor of a conspiracy theory. Somewhere along the line, kooks and nuts became the leaders, and leaders became louders, and finally… the lesson learned.
Democracy is not about mob rule, and when has the mob ever made a good choice?
However, she was partly to blame for it. To most outsiders, why such a big fight over a few words (“Little Saigon” vs “Saigon Business District”). The explanation that the diminutive “Little” demeaned the area was the worst way of thinking. Wow. You go, girl. How come Bill Gates is not very touchy about “Micro” and “Soft”.
The result was not that surprising. Of course, one could say that hindsight is 20-20. On this postmortem buzz, it can be said “They loved each other because they shared a dream…but they hated each other because there wasn’t enough of it to go around.”

* The Recall was a referendum NOT on Madison Nguyen, but ABOUT the radicalization of local business name dispute by Ly Tong’s theatrical hunger strike.
* Madison Nguyen certainly lacks political sensibility, within her own community. It will be exploited by other candidates, especially non-Vietnamese, in the 2010 election.
* Locally, Ngo Ky should learn ( from Ly tong’s defeat ) the limits of his extortion plot.
It remands people of children’s temper tantrum : If mom does not buy ice cream, child will scream in the middle of the supermarket.

Read the story again. Even in the OC Weekly. Kim Oanh did not win jack (nor Billy) other than given the permission to continue her wasteful lawsuit in which she’ll lose and get nothing in the end. It’s a simple ruling that means little. Why read so much into nothing?

Per above excerpt, the California Court of Appeal already ruled to uphold the California Superior Court’s ruling.
Perhaps the Court of Appeal’s ruling is final regarding the issue of slander unless Cao could appeal to the California Supreme Court.

Add Actual Malice Claim
(CN) - A school superintendent candidate became a victim of actual malice when school board members were told she was a Communist, a California appeals court ruled. The Westminster School District rescinded the appointment of Kimoanh Nguyen-Lam as the country’s first Vietnamese school superintendent.
Nguyen-Lam filed a defamation suit, blaming Sinh Cuong Cao for the loss of the position. The plaintiff claimed that Cao called her a Communist in a phone call to board members and repeatedly republished the false statement.
The trial court allowed Nguyen-Lam to amend her complaint to include actual malice, finding that she demonstrated a probability that she would prevail on the merits of her case.
Cao appealed the amendment to include actual malice under the anti-SLAPP law, claiming that being called a Communist is no longer a slanderous statement and is therefore not actionable.
The 4th District Court of Appeal denied Cao’s motion to strike the amendment to the lawsuit.
“The policy concerns against amendment in the anti-SLAPP context do not apply because the plaintiff’s suit - shown to be likely meritorious - is not a strategic lawsuit against public participation,” Justice Aronson wrote.
“Even assuming that defendant is correct that the Communist epithet should not be considered slander per se,” Aronson added, “plaintiff demonstrates actual damages - she lost her job.”
