Andy Quach charged with DUI – his BAC was 0.26

Westminster Councilman Andy Quach has been charged with DUI following a crash into a power pole that caused a blackout to 300 homes in his jurisdiction, according to a press release from the OC D.A. here. Lab results show that at the time of the accident, Quach’s blood alcohol concentration level was a whopping 0.26 percent — more than three times the legal limit.

The spectacular one-car crash took place on Saturday around midnight, when Quach clipped a car with three Viet occupants in it before slamming into the power pole. The resulting blackout affected 300 homes, all in the city of Westminster, and lasted all the way from midnight Saturday to past noon Sunday.

The engine to his Mercedes Benz S550 burst and caught fire, prosecutors allege.

According to the DA’s allegations, when police showed up, Quach was ”showing objective signs of intoxication including blood shot eyes, slow and slurred speech, and emitting a strong odor of alcohol on his breath and body.”

Quach also flunked the field sobriety tests (well, duh, BAC was 0.26 after all). Prosecutors claim he had “unstable balance and performing the field sobriety tests given by the police officer poorly.”

The OC Register in its story here revealed that Quach then called Assemblyman Van Tran. Tran told the Register that, over the phone, Tran “couldn’t make out what he was saying.”

Quach still insists to the Register’s Deepa Bharath that none of this means anything. “This in no way changes my abilities to make decisions as a council member,” he said.

Quach is charged with one misdemeanor count of driving under the influence of alcohol, one misdemeanor count of driving with a blood alcohol level over .08 percent, and a sentencing enhancement for having a blood alcohol level over .20 percent while driving. 

He is scheduled to be arraigned on Wednesday, Sept. 2, 2009, at the West Justice Center in Westminster.

    So, no more referring to your accident as just “nodded off”. It wasn’t. You drunk off your ass and then acted like someone slightly less fucked up than you. Stop saying that you “can never rewind and undo”. That’s not something you get to decide. The election is around the corner and the voters will undo for you. And come on, you refuse breath analyzer test is an indication of consciousness of guilt. Well, maybe you are right. Not the BAC, the toxicology report often shows traces of shiitake mushrooms that you eat causing your attention deficit disorder.

    And for the record, this is not your first raging hard-on. You have a history of hitting on stand-alone-naked-public-utility-pole (there I go again – just kidding you, she is a nice Councilwoman)

    How many viets drink and drive in our Little Saigon? Maybe 10? or 100? in every weekend? This accident is a good reminder for all of our drinking viets…….. drinking most likely will cause an accident.
