Andy Quach’s potential max penalty: 6 months

So the Bolsavik called the DA’s office today and spoke to Farrah Emami, the spokesperson. She told the Bolsavik that Andy Quach‘s maximum exposure, if convicted on all counts as well as the sentencing enhancement, is 6 months in prison plus monetary fines.

Which is pretty much the highest possible penalty for misdemeanors. One more day in jail, and it would have been a felony.

Just to summarize, Westminster Councilman Andy Quach has been charged with one count of driving under the influence, and one count of driving with blood alcohol concentration above 0.08 percent. He also faces a sentencing enhancement for driving with BAC above 0.20.

There’s a reason for an enhancement above 0.20: That’s the level that medical professionals consider to be toxic and a person’s judgment and reaction time are severely impaired, and driving at that level pretty much endangers everyone.

Quach’s level was at 0.26. (0.30 is considered life-threatening.) He clipped a car, and crashed his Mercedes-Benz S550 into a power pole and a concrete wall, plunging 300 homes into blackness as power was totally cut off and not restored until after noon the next day.

    If a person been incarcerated and spend 6 months in jail, may be a little less, how in the hell can he serve the community as a council man?

    Andy Quach’s political career is over.

    Driving over 100MPH in the city streets (Seal Beach) and driving with boold alcohol near the life-threatening level are the utmost careless behaviors. This man is not fitted to be a community leader. But I think his reckless mentality is perfect for a frontline soldier. He should reenlist and asked to be sent to Afghanistan or Irag.

    SwineBBQ , Andrew Do is the one who should be sent to the nerd house for endangering public’s health with 40 plus violations in his food business.

    Andy is more than likely to just attend few DMV classes for this accident. This was his first time offense….and hopefully the last one.

    He will start new from this bad experience and after all Andy could even become a better community leader.

    Everybody makes mistake. One poor judgement then you have to live with the consequences. However, is this incident make him a bad councilman to the extend that he can’t serve or lead or has to resign? His politial apponents and non-supporters, of course, like to say yes and his supporters surely argue the other way around. Two views, who’s right and who’s wrong? We are back to the political game and debate again. Let the record speak for itself. I don’t know what his record is so………..can somebody fill me in………..

    I weigh more than 140 and I can’t imagine even being able to drive after 9 drinks!

    Beside weight (body mass) it also depend on how many time a person drink a week? If Andy Do is a frequent drinker, say heavy drinking on week-end, with beers then go to heavy liquors, Cognac, Napoleon, Johnny Walker, to name a few…he may be more tolerable to more than 12 drinks…
    Some more prone to talk sh!t after a few drinks but he would be more clear headed even when his blood alcohol goes up above 0.20…you know what i’m saying?
    Anyway, knowing viet man drinking attitute (I used to be one) people would not stop after 4 drinks…
    Andy Do is guilty, put him in jail and throw away the key. First time DUI or not, he is a council man, he must be judged with higher standard. Where were higher moral ground talks when he was running for the office?

    Sure this or any type of misfortune is bad/negative for Andy but not detrimental.

    Bo May, drinking and driving happens in our viet town every night and this was his first offense…… I am giving him the break for this first mishap.

    Andrew Do, however, needs to be punished……. a over 40 health violations in one food business site?

    Foood poisoning is least of my worry but he can potentially spread deadly germs every single day while his store is still open. Shut it down and put Andrew Do in the can house.

    Should AQ deserve the punishment? yes because he made a bad choice driving under the influence. Should he set an example as a councilman, yes he should but he’s also human being. Simple one mistake to make him step down then unless we are spotless ourselves. Does this effect his leadership ability, somehowe becase he’s a figure head, a pubic figure. However, as long as he learn from his lesson and pay for his mistake and face the consequense, should he deserve that 2nd chance? Should the people crucify somebody who is remorsed from their own action? If the community still trust him and he’s a good councilman who work hard for his district, who will suffer if he is force to step down?

    Of course, we will consider his remorseful word but again, if I did it I would be more remorseful than Andy Quach is right now, does it mean I should get a lesser sentence? Nope! May be even more, ’cause I can’t afford an expensive Hollywood lawyer. Mr. Quack on another hand may get a very expensive parasite of the earth called Hollywood lawyer but I wish the good judge will throw him the book and send him to the can…or make him clean up the trash in public places where everyone can see, say on Bolsa Street?

    No doubt, AQ should get the same punishment as if you and I violated. If he get anything less than the ordinary citizen do then it’s not a fair game anymore, especially when he said he is willing to face and ready to face the consequences. So you think because he’s a councilman and he has good money for a good lawyer they will cut him some slack?

    Do not like buffet food of any ethnic colors…uh uh, no sirey bob…it is terrible cuisine, cooked in big bulk for profit and it always gave me the bad tummy-ache and a run, AQ probably tried to get home fast to take a dump in the can, he ended up took the pole…and may take the time in the can later in the county jail, I hope he did not wet his pant, poor police man he may think it the alcohol but it is what coming out of AQ’s bottom was worst. :)

    I would like to offer a correction and clarification to this story. As stated above, Mr. Quach’s maximum sentence for this misdemeanor is six months in jail if convicted.

    The statement that, “one more day in jail, and it would have been a felony,” however, is not correct. Misdemeanor charges can carry a maximum sentence of up to one year in jail.
